BOSTELL TERMS AND CONDITIONS

OVERVIEW

Welcome to BOSTELL at bostell.co.za. In these terms, “we”, “us” and “our” refer to Bostell, company registration number 2026/740388/07, trading as BOSTELL. “You” refers to the customer or website user.

Our business address is 1820 Moloto Street, Tshongweni Section, Katlehong, 1431, South Africa.

These terms explain how you may use our website and purchase our products. Our Return and Refund Policy, Shipping Policy and Privacy Policy also apply.

Nothing in these terms limits or excludes rights or remedies that cannot lawfully be excluded under South African law, including the Consumer Protection Act and the Electronic Communications and Transactions Act.

SECTION 1 – ACCESS AND ACCOUNT

You must have legal capacity to place an order, or appropriate permission from a parent or legal guardian.

Please provide accurate contact, billing and delivery information. Keep your account credentials secure and notify us if you suspect unauthorised access.

SECTION 2 – OUR PRODUCTS

We aim to provide accurate product descriptions, specifications and images. Colours may vary slightly depending on your screen settings. This does not affect your rights if goods are defective or materially different from their description.

Review each product’s size, specifications, ingredients and care instructions, where applicable, before ordering. Contact us if you need clarification.

Products are subject to availability. Changes to listings will not retrospectively alter orders already accepted. If an ordered product is unavailable, we will contact you to arrange an agreed alternative or a refund.

SECTION 3 – ORDERS, CANCELLATIONS, RETURNS AND REFUNDS

Order acceptance

An order acknowledgement confirms that we received your order. Acceptance occurs when we confirm acceptance or dispatch the goods.

Cancellation before dispatch

To request cancellation, email bostellstore@yahoo.com or contact 072 512 0354 with your order number as soon as possible.

If your order has not been dispatched, we will cancel it and refund your payment. If it has already been dispatched, we will explain the applicable return process. Dispatch does not remove any statutory cancellation or return rights.

Cooling-off rights for online purchases

For qualifying online purchases, you may cancel without giving a reason and without penalty within seven days after receiving the goods, subject to the exceptions in the Electronic Communications and Transactions Act.

Where this right applies, you are responsible only for the direct cost of returning the goods, and payment will be refunded within 30 days of cancellation.

Damaged, defective or incorrect goods

Where the Consumer Protection Act applies, goods that fail to meet its quality requirements may be returned within six months of delivery, without penalty and at our risk and expense. Subject to the Act, you may choose repair, replacement or a refund. Other applicable legal rights remain unaffected.

Please report damaged, defective or incorrect goods promptly so we can assist. A delay beyond three days does not automatically remove your statutory rights.

Original packaging and unused condition are not prerequisites for a valid defective-goods claim. Damage caused by misuse or unauthorised alterations will be assessed in accordance with applicable law.

Hygiene-sensitive goods and other returns

Any hygiene-related or change-of-mind restrictions apply only where permitted by law and cannot override statutory rights.

For voluntary exchanges outside statutory rights, contact us to confirm eligibility before returning goods. Any applicable conditions or costs will be explained before you agree to proceed.

Refunds

If we decline or cancel an order after receiving payment, we will refund the amount paid for the cancelled goods and any associated delivery charge that no longer applies.

Refunds will ordinarily be returned through the original payment method. We aim to initiate other agreed refunds within 10 business days after confirming the refund entitlement and receiving returned goods where required, without exceeding any applicable legal deadline.

Your bank or payment provider may take additional time to reflect the funds.

Return instructions

Contact us before returning goods so we can provide the correct return address and instructions. Our business address is not automatically the return destination for every product. This request does not limit your legal rights.

SECTION 4 – PRICES AND PAYMENT

Prices are displayed in South African rand (ZAR). Applicable taxes, delivery charges and other amounts payable to BOSTELL will be disclosed before you complete payment.

Available payment methods are shown at checkout. Orders are subject to successful payment verification.

If we identify a material pricing error, we will contact you before proceeding to explain the correction. You may accept the corrected price or cancel for a refund. We will not charge an additional amount without your agreement.

SECTION 5 – SHIPPING AND DELIVERY

Delivery destinations, charges and estimated timeframes are set out in our Shipping Policy and at checkout. Product-specific delivery information will be provided where relevant.

Please provide a complete delivery address and a reachable contact number. If you notice an error, contact us promptly.

Delivery estimates may be affected by courier operations, customs or other circumstances. If a material delay occurs, we will communicate the revised estimate and assist you with available options, including cancellation or refunds where required by law.

For delivery arranged by BOSTELL, goods remain at our risk until delivered to you or a person you authorise to receive them, subject to applicable law.

Contact us if an order is lost, damaged in transit or has not arrived within the stated delivery timeframe. We will investigate and provide an appropriate remedy.

SECTION 6 – INTELLECTUAL PROPERTY

Website content, branding, images and designs belong to BOSTELL or their respective owners or licensors and are protected by applicable intellectual property law.

You may browse the website and retain information needed for your purchase or to exercise your rights. You may not use protected content commercially without the relevant owner’s permission.

Third-party trademarks remain the property of their respective owners.

SECTION 7 – OPTIONAL TOOLS

Our website may offer tools provided by third parties. Their use may be subject to additional terms.

Nothing in this section excludes any responsibility or consumer protection that applies by law.

SECTION 8 – THIRD-PARTY LINKS

Links to external websites may be provided for convenience. Review those websites’ terms and privacy practices before using them.

An external link does not change BOSTELL’s responsibilities for purchases made directly from BOSTELL.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

BOSTELL uses Shopify to operate this online store. Purchases from the store are transactions between you and BOSTELL.

Shopify provides the platform and is not the seller of BOSTELL’s products. Questions about orders, delivery, cancellations, returns and refunds should be directed to BOSTELL.

Nothing in this section excludes rights or liabilities that cannot lawfully be excluded.

SECTION 10 – PRIVACY POLICY

We process personal information in accordance with our Privacy Policy and applicable data protection law.

Information needed to process payments and fulfil orders may be shared with relevant service providers, including Shopify, payment providers, suppliers and couriers, as explained in our Privacy Policy.

Please review our Privacy Policy for information about how personal information is collected, used, protected and shared, and how you may exercise your privacy rights.

SECTION 11 – FEEDBACK AND REVIEWS

Feedback and reviews should be truthful, relevant and respectful. Do not submit unlawful content or information that infringes another person’s rights.

When you submit a review for publication, you permit us to display it and make reasonable formatting edits without changing its meaning.

We will obtain appropriate permission before using private messages, identifiable customer photographs or other personal content for marketing.

SECTION 12 – ERRORS AND OMISSIONS

We may correct errors in website content, pricing or availability. Corrections will not remove your rights relating to an existing purchase.

If an error materially affects your order, we will contact you and explain the available options.

SECTION 13 – PROHIBITED USES

Do not use the website for fraud, unlawful activity, harassment, distributing malware, stealing personal information or infringing intellectual property rights.

Do not interfere with website security or attempt unauthorised access to accounts or systems.

SECTION 14 – AUTOMATED ACCESS

Automated tools must not disrupt the website, bypass security controls, access information without authorisation or place fraudulent orders.

Anyone using an automated tool remains responsible for the actions they authorise.

SECTION 15 – ACCOUNT SUSPENSION OR TERMINATION

We may restrict access where reasonably necessary to address fraud, security threats or material misuse.

Account suspension or termination does not remove rights relating to payments already made, accepted orders, returns, refunds or statutory remedies.

SECTION 16 – WARRANTIES AND CONSUMER RIGHTS

Products remain subject to warranties and quality protections required by applicable law, together with any additional warranty expressly offered.

We do not guarantee uninterrupted or error-free website access, but will take reasonable steps to address reported problems.

No website disclaimer excludes statutory product warranties or remedies.

SECTION 17 – LIABILITY

Each party remains responsible to the extent required by applicable law.

Nothing in these terms excludes liability that cannot lawfully be excluded, including applicable liability for defective or unsafe goods, fraud or gross negligence.

SECTION 18 – RESPONSIBILITY FOR MISUSE

You are responsible for unlawful or unauthorised conduct you carry out through the website.

Any claim relating to such conduct must be assessed under applicable law. You are not required by these terms to compensate BOSTELL for its own unlawful conduct or for losses for which you are not legally responsible.

SECTION 19 – SEVERABILITY

If a provision is found invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

SECTION 20 – ENTIRE AGREEMENT AND WAIVER

These terms, the applicable policies and the information agreed when your order is accepted form the agreement for your purchase.

Failure to enforce a provision immediately does not waive the right to enforce it later. Nothing in this section excludes legally binding representations or statutory rights.

SECTION 21 – TRANSFER OF RIGHTS AND OBLIGATIONS

Any transfer of rights or obligations must comply with applicable law and must not reduce your rights relating to an existing order.

SECTION 22 – GOVERNING LAW AND DISPUTES

These terms are governed by the laws of the Republic of South Africa.

Please contact BOSTELL first if you have a complaint so we can attempt to resolve it. You remain entitled to approach a competent court, consumer regulator, ombud or other dispute-resolution body available under applicable law.

SECTION 23 – HEADINGS

Headings are provided for convenience and do not change the meaning of these terms.

SECTION 24 – CHANGES TO THESE TERMS

We may update these terms by publishing a revised version on our website. Material changes will be communicated where required by law.

Updated terms apply prospectively and will not retrospectively change an accepted order without your agreement, except where required by law.
